General condition of sale

This contract ("Contract") is a distance contract pursuant to art. 50 ex. Of Legislative Decree 6 September 2005, n. 206 ("Consumer Code").

The Contract relates to the sale of movable goods between LOMAISTRO CALZATURE and the consumer (the "Customer").

The Contract is concluded directly through the acceptance by LOMAISTRO and a purchase proposal issued by the Customer by telephone or via the internet, following an invitation to offer content on the website www.lomaistro.com (the " Website") and/or through other remote sales systems of LOMAISTRO CALZATURE, on the basis of the methods described in the following article 3.

These general conditions of sale ("General Conditions") and, in particular, the information pursuant to art. 52 of the Consumer Code, as provided by LOMAISTRO CALZATURE will remain valid and effective until they are modified and/or integrated by LOMAISTRO CALZATURE. Any changes and/or additions to the General Conditions will be effective from the date on which they will be communicated to the public and will apply to sales made after that date. The latest updated version of the General Conditions is the one available on the Website.

PRICES

The sales prices of the products illustrated on the Site and/or through any other LOMAISTRO CALZATURE remote sales systems are inclusive of VAT. and any other tax.

Delivery costs are communicated on/from the Site and/or through any other LOMAISTRO CALZATURE remote sales systems and, in the case of a telephone order, repeated to the Customer by the operator appointed by LOMAISTRO CALZATURE

METHODS OF PACKAGING AND DELIVERY OF THE PRODUCTS

The packaging of the goods ordered through the Site is carried out directly by the Packaging Area of ​​LOMAISTRO CALZATURE and on site.

LOMAISTRO CALZATURE guarantees 100% the perfect integrity, the complete closure and the uniqueness of the package created by the

Packaging Area.

LOMAISTRO CALZATURE delivers the package, within a few hours of the order, to a manager of the company selected for shipment (the selected company will be communicated to the customer, Bartolini, SDA etc.). LOMAISTRO CALZATURE communicates to the Customer the successful delivery of the package to the "courier" and the associated and unique tracking number (shipping number). An email will be sent to the address registered with the courier tracking, to monitor the shipment.

The products will be delivered to the address indicated by the Customer within the terms established by the service of the company selected for shipping and defined during the online sale.

The customer is informed and aware of these terms which, from time to time, vary according to the type of order placed (variable weight, dimension for the packaging of the goods).

COMPLAINTS

Any complaint, however, can be forwarded: - in writing to LOMAISTRO CALZATURE in Contrada Piani 83, 83040 Castel Baronia (AV) via e-mail at info@lomaistro.com, the company makes itself available to the customer , to take care of the possible problems encountered during the order and the evasion of the same. However, LOMAISTRO CALZATURE is not liable for any misunderstandings and/or errors and/or losses attributable to the companies selected for the shipment.

PRODUCT AVAILABILITY

LOMAISTRO CALZATURE accepts the Customer's orders within the limits of the quantities of the requested products existing in the warehouse.

Therefore, the acceptance by LOMAISTRO CALZATURE of the purchase proposal forwarded by the Customer is subject to the availability of the products in stock.

LOMAISTRO CALZATURE undertakes to promptly notify the Customer of any unforeseeable out-of-stocks due to excess demand or other causes.

CUSTOMER OBLIGATIONS

The Customer declares and guarantees:

- to be a consumer in accordance with the provisions of art. 3 of the Consumer Code;

- to be of age;

- that the data provided by the same for the execution of the Contract are correct and truthful.

PRODUCT CHANGE

In the event that the product purchased is not the right one, we can replace it for you (unless

availability), within 3 days of delivery by filling out the form on the site – PRODUCT CHANGE.

Thanks to our couriers, you can take advantage of the service after collection from the comfort of your home! The courier will collect the package containing the product to be replaced. You just need to seal the package with the return and wait for collection.

As soon as you arrive at the company, we will take care of sending you the exchange of the desired product on the same day, you can check the package tracking via your email, and wait comfortably at home for the courier.

For the product change outside ITALY, agree the cost with your trusted courier at your expense.

RIGHT OF WITHDRAWAL

The Customer has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason, within 14 days of receiving the products.

The Customer may exercise the right of withdrawal, within the aforementioned term, by sending an e-mail to the e-mail address info@lomaistro.com, or by means of a written communication to the headquarters of LOMAISTRO CALZATURE, to be sent by registered letter with notice receipt or by sending an email to certified mail mail@pec.lomaistro@com. The Customer who intends to exercise the right of withdrawal must return the intact products, without causing them any defect that would prevent the sale, to the address indicated on the invoice, following the instructions contained therein, within 14 days of receipt of the products. The costs of returning the products are charged to the Customer as indicated previously in the "shipping cost" point.

LOMAISTRO CALZATURE will return the payment within 14 days from the date of receipt of the products by the Customer:

- the entire price paid by the Customer in case of return of the product complete with all its parts e

functionality;

- the part of the price equivalent to the product actually returned by the Customer who has consumed the

produced in an appreciable manner and/or such as to significantly diminish its value.

WARRANTY

For the products purchased by the Customer, the rules on guarantees and assistance relating to the sale of consumer goods are applicable to LOMAISTRO CALZATURE.

COURT OF JURISDICTION

The Contract is governed by Italian law. Any dispute relating to the application, execution,

interpretation and violation of the Contract will be the responsibility of the Court of Naples.
